Can divorce attorney’s fees be paid by spouse’s attorney?
Although rarely applicable, F.S. 57.105 (1) grants the court the authority to award attorney’s fees to the deserving party paid in equal parts by the opposing party and the opposing party’s attorney. In order to qualify for a such a penalty, the court must determine that the losing party’s attorney knew or should have known that the claim or defense he/she presented to the court either “was not supported by the material facts necessary to establish the claim or defense, or would not be supported by the application of then-existing law to those material facts” (F.S. 57.105 (1) (a-b).
